The California Department of Fish and Game is overhauling its scientific collecting permit regulations. The CDFG uses the term "scientific collecting" more broadly than the way biologists use it. Basically, it covers most research activities; under the proposed regulations:

Science” means basic research, or applied research.

“Take” includes all activities listed in Section 86 of the Fish and Game Code, as well as collecting, handling, marking, manipulating or conducting other procedures on wildlife, whether wildlife are released, or retained in possession.

The draft regulatory text and accompanying documents in fulfillment of the Administrative Procedures Act are available for review here:

This process began in 2015 with an advance notice of public rulemaking. The Ornithological Council submitted comments (attached). The agency has now published a proposed rule and is seeking comments by May 28.

The OC is analyzing the proposed regulation and plans to submit comments. They welcome your participation, including questions and comments about the proposed regulation and OC's draft comments. If you would like to submit your own comments, OC would be glad to assist you. Contact Ellen Paul.
